of Financial Law Research Association of Hubei Law Society
(passed by the Second Member Congress of Financial Law Research Association of Hubei Law Society on June 24, 2018)
Chapter I General Provisions
Article 1 In order to standardize and institutionalize the work of Financial Law Research Association of Hubei Law Society, to give full play to its important role in financial and legal research, this charter is hereby formulated in accordance with the relevant provisions of the Constitution of the Chinese Law Society and the Constitution of the Hubei Law Society and the requirements of the Hubei Law Society on "pragmatic and effective.
Article 2 The Financial Law Research Association of Hubei Law Society (referred to as the Association, the same below) is a second-level academic research group under the leadership of Hubei Law Society. It is a non-business unit and does not have the qualifications of an association legal person.
Article 3 The Association takes the strategic goal of building a well-off society in an all-round way, comprehensively deepening reforms, comprehensively governing the country according to law, and comprehensively governing the party strictly. It stresses political discipline and rules, adheres to the research method of integrating theory with practice, seeking truth from facts, Pioneering and innovating, and carrying out research activities on the theory and practice of financial law.
Chapter II Members
Article 4 Members of the Association are divided into unit members and individual members. Article 5 all units and individuals who support the articles of association of the association, have the willingness to participate in the association, engage in legal and financial theoretical research and work practice, and have no criminal record, can apply to become members of the association.
Article 6 Membership Procedure:
(I) Submit Membership Application Form;
(II) discussed and approved by the Regular Council;
(III) fill in the membership registration form.
Article 7? Members have the following rights:
(I) have the right to vote and be elected;
(II) participate in the research activities of this association;
(III) obtain the services of this association;
(IV) put forward opinions and suggestions on the work of this association.?
Article 8? Members undertake the following obligations:
(I) to abide by the law and discipline and strictly abide by the eight regulations of the central government;
(II) abide by the articles of association, implement the resolutions of the association and safeguard the legitimate rights and interests of the association;
(III) to complete the work assigned by the association;
(IV) shall not express opinions detrimental to the image of the party and the country;
(V) shall not engage in sponsorship, donation or other profit-making activities in the name of the association or its members.
Article 9 If a member does not participate in the activities of this association for one year, he will be deemed to withdraw automatically.
Article 10 If a member seriously violates the articles of association of the Association, it shall be removed by a vote of the Council or the Standing Council.
Article 11 The Association holds an annual academic seminar every year to focus on the discussion and exchange of financial law theory and practice.
Article 12 The Association actively organizes and promotes legal and financial workers to conduct special research, case analysis, consultation on difficult problems, and research activities on hot issues.
Article 13 The Association promotes contact, collaboration and discussion among its members and between its members and relevant societies.
Article 14 The Association and relevant member units shall hold financial legal training from time to time, carry out financial legal publicity and education activities, and edit and print financial legal materials.
Article 15 The Association actively organizes members to participate in the drafting, revision, consultation, and demonstration of relevant provincial and municipal departmental regulations and rules to provide theoretical support for the rule of law.
Article 16 Safeguard the legitimate rights and interests of the members of the Association.
Article 17 Actively Complete Various Legal Research Work assigned by Hubei Law Society.
Article 18 The Association shall have one president and several vice presidents. Several directors and executive directors; One secretary-general and several deputy secretaries-general; Hire an honorary president and several consultants.
Article 19 The Association implements the executive council responsibility system under the leadership of the president and secretary-general. The executive council is composed of the president, vice-president, secretary-general, deputy secretary-general, and executive directors. The Standing Council implements democratic centralism and studies and decides on major issues such as the revision of the constitution of the Association and the formulation of the annual work plan. All matters vetoed by the president, executive vice president or secretary general shall be shelved and discussed again by the standing council. The Executive Council of
meets once a year and may also meet temporarily as needed. The meeting of the Standing Council shall be presided over by the president (if it is inconvenient for the president, it shall be presided over by the Secretary General). Major matters shall be valid only after the approval of more than 2/3 of the standing directors. The council votes by means of on-site voting, telephone voting, etc.
Article 20 the president, vice president, secretary general, deputy secretary general, executive director and director of the association shall be selected by the association and the leading and affiliated units (Hubei Institute of Economics, School of Public Administration of China University of Geosciences, School of Finance and Taxation of Central South University of Economics and Law and School of Finance) through consultation, which shall be submitted to the provincial law society for approval and elected by the member congress. The term of office of the President, the Vice-Presidents, the Secretary-General and the Deputy Secretary-General shall be five years and may be re-elected.
# The president of the 104 is responsible to the provincial law society and reports on its work. The appointment of honorary president and consultant shall be proposed by the president or vice president, and approved by the president's office and submitted to the provincial law society for approval before appointment.
# The secretariat of the association under the leadership of the secretary general of the 108 is responsible for the specific implementation of the relevant work of the president's office meeting and the daily service affairs of the association such as the relevant annual meeting, academic discussion, paper selection, etc.
Article 21 The term of office of the executive director of the Association is five years. Each standing director shall be decided by the president's office.
Article 22 The official seal "Financial Law Research Association of Hubei Law Society" is uniformly printed by Hubei Law Society in accordance with relevant regulations for the daily work of meeting notices, expert invitations, evaluation and awards of financial law research conducted by the Society, and shall not be used for investment and shareholding, private lending, social fund-raising, guarantee intermediary and other business activities.
Article 23 The conference fees, research results and paper award funds necessary for academic research conducted by the Council and its Standing Committee shall be borne by financial institutions, law firms and institutions of higher learning in member units through negotiation, while the shortfall shall be shared by other member units through negotiation. The funds shall be budgeted in the form of academic research activities of the Association and submitted to the undertaking and sharing units, which shall be handled by the undertaking and sharing units in accordance with their management regulations such as conference fees.
Article 24 The Association does not open an account, and all its members and related personnel are not allowed to receive remuneration in any name and obtain economic benefits except for overtime travel, conference research, research results and paper award bonuses.
Article 25 Changes in the name of the Association and important matters such as president, vice president and secretary general shall be reported to Hubei Law Society for approval.
Article 26 This Articles of Association shall be implemented after being approved by more than half of the member representatives attending the inaugural meeting of the Association, and shall be reported to Hubei Law Society for the record.
Article 27 The Articles of Association shall be interpreted by the Standing Council.
